Terms and Conditions
OVERVIEW
These terms and conditions (the “Terms and Conditions”) govern the delivery, use and function of;
(a) The BrewBank App (the “App”).
(b) The use of www.brewbank.com.au and www.brewbank.app (the “Sites”).
(c) The use of the BrewBank pre-paid coffee system (the “System”).
(d) The BrewBank card, a virtual pre-paid coffee card (the “Card”/”Cards”).
(e) Participating BrewBank cafés, a network of individual distribution partners of the BrewBank Cards, via the App (the “Café”/”Cafés”).
(f) Coffee and Café-related equipment producers and distributors, who are contractually related to the BrewBank System (the “Distributors”).
The App, Site and System are owned and operated by Brew App Pty Ltd (ABN 37 682 953 911) (“BrewBank”, “Us”, “We”, “Our”).
BrewBank offers a pre-paid system to Cafés for their customers to purchase pre-paid Cards in packs of 5x coffees, 10x coffees, or 20x coffees. Further iterations of the App and System will change over time including promotions, referral programs, and gifting coffees through the System.
Within these Terms and Conditions, “you”, and “your” refer to the end consumer, which is any individual (or other entity) who downloads the BrewBank App, purchases a BrewBank Card, or uses the BrewBank Sites.
1. BREWBANK SYSTEM
To purchase a pre-paid coffee Card, at a discount provided by the Café, you need to use the BrewBank App. You cannot access the BrewBank System without the App. The App is available through the Apple App Store and the Google Play Store.
1.1. WEBSITE AND APP ACCESS AND TERMS
By using the App, Sites and System, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
When you register an account and throughout the use of the Site or App, you may need to provide us with information such as your full name, email address, postcode, birthday, phone number, and credit or debit information. You will also need to choose a password. You are responsible for remembering your password. Information about how this is used and stored is outlined in our Privacy Policy.
You are responsible for any activity that is carried out on the Site or App under your account, or with your device. You are responsible for ensuring that anyone who uses your device or account is aware of these Terms and Conditions and complies with them.
1.2. CARD PURCHASING
On the App, Cards of 5x coffees, 10x coffees, and 20x coffees are available for purchase via the use of a credit or debit card, facilitated by Stripe Payments Australia Pty Ltd (“Stripe”).
Once a Card is purchased, you cannot change the type of coffee, add-ons, or amount of coffees on the Card. Purchased Cards will be displayed within the BrewBank App. As each coffee is redeemed your Card will be deducted until there are no coffees left. You can then recharge using the same credit or debit card process. You may also purchase multiple cards and redeem them concurrently – separate cards may have separate coffee orders, be assigned to different Cafés, and be of different quantities of coffees.
1.3. DISCOUNTS AND MODIFICATION TO PRICING
BrewBank offers a flat discount of 10% for the 5x Coffee Card, 15% for the 10x Coffee Card, and 20% for the 20x Coffee Card. BrewBank has the ability to change the discounts or available quantities of Cards at any time. If the discounts change, cards that have already been purchased will remain unaffected, however additional Card purchases and Card recharges will be affected. Once you have purchased a Card your discount and price for coffee is locked until you purchase your next Card. Note this pre-paid process also avoids common purchase surcharges, often applied during weekends and public holidays. All transactions for BrewBank Cards will also incur an online transaction fee. This fee is currently 1.9% + $0.30AUD per card transaction.
1.4. CARD REDEMPTION
Once purchased the Card will be instantly available on your App to redeem. Redemption is available via scanning the Cafés QR code using the BrewBank scanner. Coffees can also be redeemed remotely from the Café while using the App. Note that once an order is placed it is the customers responsibility to be available to pick the coffee up within a reasonable time. Once an order is placed via the App it cannot be changed, cancelled or refunded.
1.5. LIMITATIONS AND EXPIRY
Customers can have multiple cards within the BrewBank App. This enables you to enjoy the BrewBank discounts at multiple Cafés that you may frequently customer. There is a limit to the amount of Cards you can have, currently set at 10 individual Cards. At this stage, Cards do not have an expiration period.
2. PRICING AND PAYMENTS
All prices quoted on the App or Site are in Australian dollars. These prices include any applicable taxes but may exclude additional fees including any administration fee, service fee, or online payment merchant fee, as implemented by Stripe. Final costs will always be shown to you at the time of purchasing a Card, via the Stripe API Integration.
2.1. REFUNDS AND CANCELLATIONS
Once you purchase a Card and your payment has been authorised, you will not be eligible to change or cancel your Card. If you wish to cancel, change or refund your card, you may contact the Café directly. There is no guarantee or implication that the Café will oblige in cancelling, changing or refunding your Card.
2.2. PROOF OF IDENTITY
You may be required to show the credit or debit card used to purchase your Card to the Café at the time of collection, as proof of identification and so that they can check that the credit or debit card conforms with the purchase or receipt data for the Card or order. The Café also has the right to request other forms of photo identification to be presented, as a method of fraud prevention.
2.3. PAYMENT DELAYS OR UNAUTHORISED TRANSACTIONS
Please note that from time to time there may be delays with the processing of card payments and transactions; this may result in delays in sums being deducted from your bank account or charged to your credit or debit card. Also note that failed payments or unauthorised transactions will result in the purchase of a Card being declined, or otherwise incur a debt to BrewBank on behalf of the associated Café.
2.4. INCORRECT DISPLAY OF PRICING
It is possible that a Card may display incorrect pricing. Cards will be sold for the displayed price even if the correct price for the discounted coffees is higher than the price stated on the App or Site. If you notice an error with the displayed pricing, it is your responsibility to cancel the transaction before paying, and notifying BrewBank and the Café.
2.5. PAYMENT FACILITIES AND DATA COLLECTION
All transactions are facilitated via credit or debit card by our payment provider, Stripe Payments Australia Pty Ltd (“Stripe”). Stripe may also offer service with Apple Pay and Google Pay, at no additional fees. There is currently no other payment methods available. We do not store any payment details. You may elect to save your credit or debit card within the App for future purchases. This is collected, stored and encrypted by Stripe and BrewBank bears no responsibility for the use or misuse of this data.
3. INTELLECTUAL PROPERTY
All content published and made available on our Site, App and System are the property of BrewBank. This includes, but is not limited to images, text, logos, documents, code, downloadable files, and anything that contributes to the composition of the App, Site, System and Card.
4. ACCEPTABLE USE
As a user of our App, Site and Card, you agree to use these legally, not to use them for illegal purposes, and not to:
• Violate the intellectual property rights of the owners or any third party to the Site;
• Misuse any data on the Site or App, including by “hacking” or “scraping”;
• Act in any way that could be considered fraudulent; or
• Post any material that may be deemed inappropriate or offensive.
If we believe you are using our App, Site, and Card illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, pause, suspend or terminate your access to your BrewBank account. We also reserve the right to take any legal steps necessary to prevent you from accessing our System. If your account is limited, paused, suspended, or terminated, you will lose all BrewBank Cards and purchases without any refund or reimbursement.
5. THIRD PARTY GOODS AND SERVICES
Our Site and App may offer services from third parties. We are not liable for the quality or accuracy of goods and services made available by third parties on our Site.
Our Site and App may contain links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third-party websites before using these sites.
6. MOBILE TERMS OF SERVICE
The BrewBank mobile message service (the “Mobile Service”) is operated by BrewBank
Your use of the Mobile Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Mobile Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Mobile Service following the effective date of any such changes shall constitute your acceptance of such changes.
By consenting to BrewBank’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of BrewBank through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).
You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with BrewBank. Your participation in this program is completely voluntary.
We do not charge for the Mobile Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.
You may opt-out of the Mobile Service at any time. Text the single keyword command STOP to BrewBank or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other BrewBank mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Mobile Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Mobile Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.
To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Mobile Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Mobile Service.

7. LIMITATION OF LIABILITY
BrewBank and our directors, officers, shareholders, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, and expenses including legal fees from your use of the System, App, Sites and Cards.
BrewBank is not responsible for unused Cards and Coffees on your phone if you stop using the System, lose or damage your phone/device, or for other reasons that you stop using BrewBank. Accidental redemptions of Coffees are
BrewBank is not responsible for Cafés within our network to be open or operating. While BrewBank applies its due diligence when onboarding Cafés to our System, it is your responsibility to ensure that you only purchase Cards from Cafés that are trusted by you. If a Café opens late, is closed for holidays or stops operating for a period of time or permanently, then BrewBank is not liable or responsible for the unredeemed Cards redeemable at that Café. Any matters or disputes regarding this should be discussed and resolved with the Café.
8. INDEMNITY
Except where prohibited by law, by using the Site and Card you indemnify and hold harmless BrewBank and our directors, officers, agents, shareholders, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of the System, App, Sites and/or Cards or your violation of these Terms and Conditions.
9. APPLICABLE LAW
These Terms and Conditions are governed by the laws of the State of New South Wales, in Australia.
10. SEVERABILITY
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
11. CHANGES
These Terms and Conditions may be amended from time to time to maintain compliance with the law and to reflect any changes to the way we operate and the way we expect users to behave when using our Site and Card.
